Financial Fraud. Deceived by “Ergo Portal.” Releasing Affirmations

If you type the phrase “deceived by Ergo Portal” into an internet search engine, you will find many pages devoted to this Kraków-based company.

An employee of the company calls people who run businesses. He suggests that they register online as users of the portal. The registration is free. However, the client later receives information in their mailbox stating that if they do not withdraw within 10 days, then after that time they must pay the company “Ergo Portal” an amount of nearly 800 PLN in monthly installments of 56 PLN. It is possible to overlook the information about the costs, and later debt collectors are sent after the reluctant ones.

Of course, one cannot accuse the company of illegal conduct, but there is an ethical stench perceptible in the way it operates.

There is an enormous amount of financial fraud all over the world, and in order to free oneself from similar entanglements, a text once developed for liberation from the harmful actions of a certain English company called “Swing” may be useful.

The party suing me clearly expressed during the telephone conversation its will and desire to conclude an agreement of a specified content without any costs on my part.

Considering that during the telephone conversation all essential provisions of the agreement were established, I accepted the oral offer made by the contractor, and thus an agreement for the provision of free services was concluded.

Such an assurance was given to me by telephone by the recruiter from the portal called “Ergo.”

I refuse to pay the invoices due to the deliberate, destructive, and conscious lie used by the company employee in order to persuade me to register. He told me by telephone:

1a) that the service was completely free.
1b) that I would incur no costs related to registration and use.

2. This employee lied to me deliberately by not telling me that the service was paid.
3. This employee lied to me deliberately by not telling me that there was a trial period and that for the later period of “use” I would have to pay them.
4. This employee lied to me deliberately by not telling me that there were discrepancies between what he said during recruitment and what was stated in the agreement sent to me by email, where the costs I was to bear were given.

It should be noted that the written agreement sent by email and inconsistent with the oral agreement does not constitute confirmation of it.

I refuse to pay because of the deliberate, destructive, and conscious lies used by the company not only to persuade me but also others to register. This company intentionally and consciously feeds on lies, omissions, and the desire to enrich itself through deception.

It is not difficult to calculate that with 100 deceived clients per month they have a clean turnover of:
100 × 700 PLN = 70,000 PLN.

As evidence of the company’s deceitful activity, I attach 4 computer screenshots describing problems they caused to other similarly deceived persons. The search phrase is: “deceived by Ergo Portal.”

I am aware that a collective lawsuit of deceived persons has been filed in court, already signed by 160 people.

I refuse to pay because I was not informed of the need to immediately read the email with the agreement, where the costs I was to bear were stated.

Not being aware of this important necessity, I did not check my email during the time that the company, without my knowledge, designated as a trial period for the persons it deceived.

Therefore, I could not terminate the agreement within that period.

I refuse to pay because, after the first login (made in accordance with the intentionally false information given to me), I never again used the Ergo portal or any other services of this company.
